Every workplace investigation I conduct follows a structured, evidence-based methodology designed to ensure findings are objective, policy-aligned, and capable of withstanding internal review, external scrutiny, or legal examination. Here’s what you can expect when you engage Kaminski Investigations & Compliance:
Step 1: Intake & Scope Definition
We start with a confidential conversation to understand the allegations, identify key parties, and determine what needs to be investigated. I’ll ask clarifying questions, review relevant policies, and help you define the scope - what’s in bounds and what’s not; this prevents scope creep, manages expectations, and ensures we’re investigating the right questions. It also protects the organization from inadvertently expanding the inquiry in ways that could create legal risk.
Step 2: Investigation Planning
I develop a detailed investigation plan outlining who will be interviewed, what documents need review, and anticipated timeline. You will receive a written scope agreement ensuring alignment on approach and priorities.
Step 3: Document & Evidence Review
I review all relevant documents including emails, text messages, performance reviews, HR files, policies, prior complaints, or any other relevant materials that could shed light on the allegations. I look for patterns, corroboration, contradictions, and context.
Step 4: Interviews
I conduct confidential, one-on-one interviews with the complainant, the respondent, and relevant witnesses. I use trauma-informed interviewing techniques that are respectful and thorough. I do not record interviews but take comprehensive contemporaneous notes.
Step 5: Evidence Analysis
I review all evidence - interview notes, documents, policies, timelines - and assess credibility, consistency, and corroboration. I apply your organization’s policies and relevant legal standards to determine whether allegations are substantiated, unsubstantiated, or inconclusive.
Step 6: Findings & Written Report
I deliver a comprehensive written report designed to withstand legal scrutiny and can be shared with regulators, board members, or external parties if needed.
Step 7: Leadership Debrief
I walk through the report, answer questions, clarify findings, and discuss implementation of recommendations. This is your opportunity to fully understand the conclusions and ensure you’re equipped to take appropriate action.
